- M v M (Abduction: Settlement) [2008] 2 FLR 1884 where Black J refused to return children to Poland notwithstanding that they had been in the UK for more than 12 months and the children’s strong wish to remain in the UK.
- Re F (A Child) [2009] EWCA Civ 416 where the Court of Appeal approved the decision of the judge to decline to return a 7 year old child in abduction proceedings on the basis of the child’s own views. Thorpe LJ also gave guidance on how to resolve conflicts of expert evidence as to whether a parent has ‘rights of custody’ under foreign law in Brussels II cases.
